1. Acceptance of Terms
By downloading, installing, or using any mobile application published by KangaBlue (“we,” “our,” or “us”), including but not limited to FixerUppera, StyleMySpace, and NovaSuperAgent (collectively, the “Apps”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Apps.
2. Description of Services
KangaBlue develops and publishes AI-powered mobile applications. Our current Apps include:
- FixerUppera — AI-powered furniture transformation planning with photo analysis, DIY plans, shopping lists, and concept preview mockups
- StyleMySpace — AI-powered interior design with room analysis, transformation mockups, paint selection, Design Battle mode, and Feng Shui analysis
- NovaSuperAgent — An AI personal assistant with tool execution, voice control, email integration, proactive intelligence, and persistent memory
We may add, modify, or discontinue Apps or features at any time. These Terms apply to all current and future KangaBlue Apps.
3. User Eligibility
You must be at least 13 years of age to use our Apps. By using any App, you represent that you are at least 13 years old. If you are under 18, you should use our Apps only with the involvement of a parent or guardian.
4. User Responsibilities
When using our Apps, you agree to:
- Use the Apps only for their intended purposes
- Only upload photos and content that you have the right to use
- Not upload content that is inappropriate, illegal, or harmful
- Not attempt to reverse-engineer, decompile, or tamper with our Apps
- Not use our Apps to infringe on the intellectual property rights of others
- Follow all applicable safety guidelines when undertaking projects based on App suggestions
- Not use our Apps for any unlawful purpose or in violation of any applicable laws
5. AI-Generated Content Disclaimer
Our Apps use artificial intelligence to generate content including plans, ideas, mockups, text, analysis, and recommendations. You acknowledge and agree that:
- AI content is for informational and inspirational purposes only. Generated content should not be treated as professional advice (including but not limited to home improvement, interior design, financial, legal, or medical advice).
- Visual mockups are concept previews. AI-generated images show possible outcomes. Actual results will vary depending on materials, techniques, skill level, and other factors.
- Cost and time estimates are approximate. Actual costs and time required may differ based on local pricing, availability, and project complexity.
- AI may produce errors. Generated content may contain inaccuracies, impractical suggestions, or unsuitable recommendations. Always use your own judgment and consult qualified professionals when appropriate.
- Safety is your responsibility. Always follow proper safety precautions when using tools, chemicals, paints, and other materials. Consult licensed professionals for structural, electrical, or plumbing work.
6. Intellectual Property
6.1 Our Content
Our Apps, including their design, code, graphics, animations, branding, and documentation, are owned by KangaBlue and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Apps without permission.
6.2 Your Content
You retain ownership of any photos, text, or other content you provide. By uploading content, you grant us a limited, non-exclusive license to process it through our AI services solely for the purpose of providing our Apps’ functionality. We do not claim ownership of your content.
6.3 AI-Generated Content
You are free to use AI-generated content produced by our Apps for your personal use. We make no claim of exclusivity over AI-generated content, and the same or similar outputs may be generated for other users.
7. Subscriptions and Payments
7.1 Free and Paid Features
Our Apps may offer free features with limited usage, as well as paid subscription tiers with increased or unlimited access. Feature availability and pricing may vary by App.
7.2 Billing
Subscriptions are billed through Google Play on a monthly or annual basis. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
7.3 Cancellation and Refunds
You can manage and cancel subscriptions through Google Play’s subscription management settings. Refund requests are handled by Google Play in accordance with their refund policies. If you believe you have been charged in error, please contact Google Play support or email us at skippy@kangablue.au.
7.4 Price Changes
We reserve the right to change subscription prices. Existing subscribers will be notified of price changes in advance through Google Play.
8. Third-Party Services
Our Apps rely on third-party AI services (including OpenAI, Anthropic, and Alibaba Cloud), hosting infrastructure (Vercel, Railway), and platform services (Google Play, Microsoft) to function. We are not responsible for the availability, accuracy, or performance of these third-party services. Service interruptions or changes by these providers may temporarily affect App functionality.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
- Our Apps are provided “as is” and “as available” without warranties of any kind, express or implied.
- We do not warrant that our Apps will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any damages resulting from your use of AI-generated content, including but not limited to property damage, personal injury, or financial loss.
- We are not liable for any damages resulting from undertaking projects, tasks, or actions based on our Apps’ suggestions.
- Our total liability shall not exceed the amount you have paid to us for the applicable App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless KangaBlue, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our Apps or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate access to any App at any time, without notice, for any reason. You may stop using any App at any time by uninstalling it from your device. Sections 5, 6, 9, and 10 survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of our Apps after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
